Cross-Border Civil Litigation in Switzerland
Following Brexit, in legal proceedings initiated on or after 1 January 2021, any UK-Swiss dispute in Switzerland is governed by the Swiss Private International Law Act (PILA), which lay out specific rules and principles depending upon the nature of the dispute at hand. Generally, the Swiss courts at the defendant's seat or place of residence have jurisdiction unless PILA provides otherwise.
In contractual disputes between a UK party and a Swiss party, and provided the contract does not contain an arbitration clause, the Swiss authorities at the defendant’s place of business may have jurisdiction for claims arising out of the contract. This is particularly true when the performance of the main obligation under the contract must be executed in Switzerland.
